LA PARTICIPATION DE LA VICTIME À LA PROCÉDURE DEVANT LE TRIBUNAL SPÉCIAL POUR LE LIBAN

Résumé

À l’image de l’une des évolutions introduites par la Cour pénale internationale, le Tribunal spécial pour le Liban offre à la « victime » un rôle jadis minoré, voire ignoré par le droit pénal international : la participation active à la procédure. Celle-ci s’exerce à travers des droits variés, définis globalement dans le Statut du Tribunal spécial pour le Liban comme le Règlement de procédure et de preuve du Tribunal. Toutefois, entre les conditions attachées à une autorisation à participer à la procédure et les limites diverses inhérentes aux différents droits, l’on peut craindre une implication a minima de la victime, sans pour autant la réduire à néant.

Abstract

As with the evolution of the law of the International Criminal Court, the Special Tribunal for Lebanon introduces the same change that was previously unknown by the international criminal law: the active participation of the victim. This is possible through various rights that are enshrined both in the Statute of the Special Tribunal for Lebanon and the Rules of Procedure and Evidence of the Tribunal. However between the conditions relating to the right to participate as victim and the different restrictions attached to various rights, it is feared that those rights will be of minimum help for the victim participating.
