LA PROTECTION DE L’ENFANT EN DROIT INTERNATIONAL PRIVÉ TUNISIEN : L’EXEMPLE DE LA GARDE (OU HADHANA)

Résumé

Institution particulière au droit musulman, la garde (ou hadhana) se compose principalement de deux éléments : la protection de l’enfant (direction et surveillance) et sa première éducation. Le droit musulman établit à propos de la hadhana un ordre de mérite qui profite à la mère et aux parents de la lignée maternelle. Une grande partie de la doctrine envisage la hadhana comme un démembrement de la tutelle (ou wilaya) sur la personne – laquelle est une prérogative reconnue de manière quasi-exclusive au père et à la lignée paternelle – ; cette perception met l’accent sur les problèmes de frontières entre les deux institutions. Dans le droit positif actuel, la question de la garde offre un terrain propice aux conflits d’intérêts entre les différentes parties concernées : le père, la mère et l’enfant. La matière recèle une forte impérativité en droit interne, ce qui explique son caractère indisponible. Sur la scène internationale, la volonté de favoriser l’enfant s’est traduite par l’adoption d’une règle de conflit à caractère substantiel qui conduit à l’application de la loi la plus favorable à l’enfant. Cependant, la jurisprudence tunisienne considère, depuis quelques temps, qu’il existe en matière de hadhana une réserve d’ordre public, qui justifie le refus de l’accorder au conjoint qui n’est pas de religion musulmane. L’ampleur de cette réserve se vérifie de manière particulière au stade de la réception des décisions étrangères. Ainsi, lorsque la garde est conférée par un tribunal étranger à la mère étrangère non-musulmane, les juridictions tunisiennes se préoccupent davantage de la tutelle exercée par le père tunisien.

Abstract

Particular institution of the Muslim legal system, the custody of the child (or hadhana) is made up for the most part of two elements: the child’s protection (direction and supervision) and the primary education. Regarding the hadhana, the Muslim law establishes a merit order in favor of the mother and the parents of maternal lineage. A major part of the doctrine considers the hadhana as a division of the guardianship (or wilaya) on the person, which is a known prerogative of the father and the parents of paternal lineage. This perception emphasizes the boundary problems between the two institutions. In the actual positive law, the custody question offers a favorable environment to the conflict of interests between all the parties involved: the father, the mother and the child. This subject holds an imperative character in internal law, which explains its unavailable character. On the international scene, the will to favor the child has been materialized by the adoption of a conflict rule of substantial character which leads to using the law most beneficial for the child. However, the Tunisian jurisprudence considers that there is a public order reservation which permits that the hadhana will be given to the partner of Muslim religion. The scope of the reservation can be confirmed when looking at the consideration of foreigners’ case law. In particular, when the custody is given by a foreign court to a non Muslim mother, the Tunisian jurisdiction has a tendency to favor the Tunisian father.
