Les marchés publics : étude des obligations internationales du Canada, du GATT à l'ALENA

Résumé

Le but premier du présent article est de fournir au lecteur une analyse détaillée et critique du chapitre 10 de l'ALENA qui traite des marchés publics. Le texte constitue aussi une introduction aux obligations internationales du Canada en matière de marchés publics puisqu'il en rappelle les sources et les concepts de base. Aussi l'auteure commente-t-elle, dans sa première partie, le Code sur les marchés publics du GATT de 1979, tout en demeurant critique quant à son influence au Canada. Par la même occasion, elle met en relief les dispositions intéressantes du nouveau Code du GATT sur les marchés publics adopté à l'issue des négociations de l'Uruguay Round, en décembre 1993. Le chapitre 13 de l’ALE est lui aussi abordé par l'auteure; cependant, dans ce cas, c'est surtout la tribune de contestation des marchés qui a retenu son attention.

Abstract

The primary purpose of this paper is to provide the reader with a detailed and critical analysis of Chapter 10 of NAFTA which deals with government procurement. The text is also intended to be an introduction to Canada's international obligations regarding government procurement since it reviews their sources and basic concepts. As such, in the first part the author comments on the 1979 GATT Agreement on Government Procurement while remaining critical with regard to its impact on Canada. In the same vein, she emphasizes interesting provisions under the new GATT Agreement on Government Procurement adopted at the Uruguay Round negotiations in December 1993. Chapter 13 of the FTA is also addressed by the author; yet under this heading she mainly deals with the tribunal for challenging such procurement.
